In einer vergleichenden Analyse sollen beide Konzeptionen gegenübergestellt werden, wobei vor allem die Betrachtung der verschiedenen Funktionen, die der Begriff Ausnahmezustand in den jeweiligen Argumentationen erfüllt, im Vordergrund der Auseinandersetzung stehen wird. Zu diesem Zweck möchte ich in einem ersten Schritt auf Carl Schmitt eingehen. Dabei soll herausgearbeitet werden, wie Schmitt den Terminus Ausnahmezustand im Rahmen seiner Überlegungen zur „Politischen Theologie“ definiert, und welche Funktionen diesem Begriff innerhalb Schmitts Souveränitätskonzeption zukommen. Die Auseinandersetzung mit dem Terminus Ausnahmezustand, so wie sich dieser bei Carl Schmitt darstellt, bildet die Ausgangsbasis der vorliegenden Arbeit. An diese Überlegungen anschließend, möchte ich mich der Argumentation Giorgio Agambens widmen, die –wie bereits erwähnt- den Terminus Ausnahmezustand von Carl Schmitt übernimmt. Hierbei stellt sich erneut die Frage nach der Funktion und der begrifflichen Bestimmung dieses Terminus. Darüber hinaus wird an dieser Stelle auf grundlegende Unterschiede im Bezug auf Carl Schmitts Begriff des Ausnahmezustands eingegangen werden. Im Mittelpunkt einer vergleichenden Auseinandersetzung sollen vor allem Fragen nach der begrifflichen Veränderung und konzeptionellen Abwandlung des Terminus Ausnahmezustand bei Agamben stehen. Überdies stellt sich die Frage nach der Relevanz, die diesem Begriff in Agambens Argumentation, im Vergleich zu Carl Schmitts Verwendung des Terminus Ausnahmezustand, zukommt. Nach dieser vergleichenden Gegenüberstellung der unterschiedlichen Perspektiven auf den Begriff Ausnahmezustand, möchte ich abschließend die Frage behandeln, inwieweit die von Agamben formulierte Bezugnahme auf Carl Schmitts Verwendung des Terminus Ausnahmezustand problematisch ist. Um diese Fragen klären zu können, werde ich mich im Folgenden anhand einiger ausgewählter Aspekte mit der Thematik auseinandersetzen.
